Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Pitch Arena (the “Service”), a sales-training application operated by SalesUp (“SalesUp”, “we”, “us” or “our”), available at https://pitcharena.club. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Pitch Arena lets sales development representatives practise cold calls against AI-generated prospect personas over live voice, and provides automated scoring, feedback, progress tracking and related gamification. The Service is provided on a software-as-a-service basis and may evolve over time.

2. Accounts and organizations

  • You must provide accurate information and keep your account credentials secure. You are responsible for activity under your account.
  • The Service is organized into teams (“organizations”). An organization administrator may invite, manage and remove members, and may view usage and call history for members of their organization.
  • You must be at least 16 years old, and old enough to form a binding contract in your jurisdiction, to use the Service.

3. Acceptable use

You agree not to:

  • use the Service for any unlawful, harmful, or abusive purpose;
  • attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its infrastructure;
  • upload content you do not have the right to use, or that is unlawful, infringing, or offensive;
  • use the Service to record or impersonate a real, identifiable third party without their consent; or
  • resell or provide the Service to third parties except through your own organization’s seats.

4. Subscriptions, seats and payment

  • Paid plans are billed per seat, per month. Prices are shown in the app at checkout. A free tier with limited practice usage is also available.
  • Payments are processed by our Merchant of Record, Paddle (Paddle.com Market Limited and its affiliates). Paddle handles billing, invoicing and applicable taxes. Your purchase is also subject to Paddle’s buyer terms.
  • Subscriptions renew automatically each billing period until cancelled. You can cancel at any time from the billing area; access continues until the end of the paid period.
  • Fees are stated exclusive of taxes unless noted; you are responsible for any applicable taxes, which Paddle may collect.
  • Refunds are governed by our Refund Policy.

5. Fair-use limits

To protect the Service for everyone, practice minutes are subject to a reasonable fair-use ceiling that scales with your seat count. These limits are intended only to prevent abuse, not to meter normal use. We may contact you before applying any limit.

6. AI-generated content

The Service uses artificial intelligence (including large language models) to generate prospect responses, scores and feedback. AI output can be inaccurate or incomplete and is provided for training purposes only. It is not professional, legal, financial or employment advice, and should not be the sole basis for any decision, including any decision about a real person’s performance or employment.

7. Your content and call recordings

You retain ownership of the audio, transcripts and other content you create using the Service (“Your Content”). You grant us a limited licence to host, process and analyse Your Content solely to provide and improve the Service, as described in our Privacy Notice. Calls may be recorded and transcribed so we can score them and let you review them.

8. Intellectual property

The Service, including its software, design, personas and branding, is owned by SalesUp and its licensors and is protected by intellectual-property laws. Except for the rights expressly granted here, we reserve all rights.

9. Third-party services

The Service relies on third-party providers (for example, for voice transport, speech processing, AI, data hosting, email and payments). Your use may be subject to those providers’ terms, and we are not responsible for third-party services outside our control.

10. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or secure.

11. Limitation of liability

To the maximum extent permitted by law, SalesUp will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us or others. On termination, your right to use the Service ends; sections that by their nature should survive will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. Disputes will be subject to the courts of that jurisdiction, unless mandatory local law provides otherwise.
